Online Subscription Panel Terms of Service

These Qualtrics Online Subscription Panel Terms of Service govern any statement of work or service order between you (“Customer”) and Qualtrics.

This Cloud Service provides Customer access to a dataset of potential respondents from whom Customer can collect Human Panel Responses or Synthetic Panel Responses up to the number of Credits purchased and subject to the availability of a target audience via the dataset of potential respondents.

 

Definitions:

Human Panel Response: A Human Panel Response is recorded and counted for completed and partially completed responses to any survey sent out by a User to a potential respondent, subject to the following: (i) Customers will be provided with the functionality necessary to determine whether only fully completed responses are recorded or whether partially completed responses are also recorded as a Human Panel Response; (ii) if a Customer determines that partial responses will be recorded, those partial responses will count as full responses for the purposes of this Usage Metric; (iii) any response not recorded in accordance with (i) and (ii) will be deleted instead; and (iv) once a response has been recorded, it can be deleted but will still count against the total number of Credits a Customer has purchased unless deleted as a part of the data scrub process, in which case the deleted response will not count against the total number of Credits.

Synthetic Panel Response: A Synthetic Panel Response is recorded and counted for any response generated by algorithmic means subject to the following: (i) Customers will be provided with the functionality to identify a Synthetic Panel Response; and (ii) once a response has been recorded, it can be deleted but will still count against the total number of Synthetic Panel Responses a Customer has purchased.

 

Terms of Use:

  1. Qualtrics is not responsible for the following: (a) a survey response rate; (b) designing survey questions; (c) building dashboards; or (d) providing any deliverable.
  2. Customer shall not collect any Personal Information of respondents. Each party shall comply with applicable laws, rules, and regulations, including applicable data privacy laws (in Qualtrics’ case, as a data processor, and in Customer’s case, as a data controller).
  3. Each Human Panel Response or Synthetic Panel Response consumed shall also consume an Interaction under Customer's Interaction-based Cloud subscription.
  4. Credits shall expire after 12-months and shall not rollover.
  5. Project feasibility and timeline are based on the inputs (e.g., LOI and IR) provided by Customer without review by Qualtrics. Should such inputs prove to be inaccurate, Qualtrics reserves the right to reassess project feasibility and/or timeline.
  6. Human Panel Responses are administered through verified third party platforms. If Customer's license includes Data Isolation, Customer's Human Panel Response data will be data isolated within Qualtrics but panel configuration details provided at launch will not be isolated.
